GERALD S. SIEGMYER practices in the areas of commercial and securities litigation.
A native of Cleveland , Ohio , Jerry was born September 12, 1947. He obtained his B.A. from Montana State University in 1970 and his J.D. from Southern Methodist University in 1973. He is licensed to practice in the Federal courts in the Southern District of Texas-Houston Division, and the Fifth Circuit U.S. Court of Appeals. Jerry served five years with the Texas Securities Board, ending his tenure as Assistant Director of its Enforcement Division.
Selected Cases
Diamond J. Equipment Int’l, L.L.C. v. Microbial Enhanced Oil Recovery, L.L.C. After we filed a motion for summary judgment in advance of the scheduling conference in this case, we obtained a dismissal of this $6 million breach-of-contract and post profits claim arising out of MEOR’s termination of distributorship agreement with Diamond J. The case was filed before Judge Werlein in Houston Federal Court.
Horton, et al v. Southwest Securities, Inc. Represented multiple investors in “selling away” investment fraud scheme perpetrated by sales representative against major securities broker-dealer that refused to take responsibility for the actions of its sales force. Result – Confidential settlement in 2005.
El Paso Refinery Bankruptcy Litigation. Represented Litwin Engineers & Constructors, Inc., in a claim to enforce its mechanics & materialmen’s lien against El Paso Refinery in bankruptcy court and defended against a counterclaim by the refinery for construction defects allegedly caused by Litwin. Result – refinery’s defect claim dismissed by agreement after evidence assembled by counterclaimant/defense failed to show any defects existed; Litwin successfully enforced its M&M lien. Litwin received over 100% of amount of its claim.
Superior Carriers, Inc. v. Construction Remedies Corporation, et al Litigation. Superior Carriers is the third largest bulk transport company in the country. Represented Superior in connection with litigation with Mechanic’s & Materialmen’s Lien claimants arising out of a construction project in Pasadena, Texas after the general contractor defaulted on the contract and left the jobsite leaving dozens of unpaid labor and material suppliers in his wake. Result – consolidated all claims into one case to save expenses. All claims settled within budget without the expense of trial and a judgment obtained against the general contractor.
Tideport v. Quala Wash, Inc. Represented Tideport, a subsidiary of Quality Distribution, Inc., the largest bulk transport company in U.S. , in federal court lawsuit claiming that a caustic cleaning substance allegedly used by Quala Wash caused the plaintiff’s aluminum trailers to corrode. Result- the plaintiff abandoned the case after evidence assembled by defense showed that the chemical transported by plaintiff caused the corrosion not the cleaning substances used by Quala Wash. Plaintiff received nothing.
